These General Terms and Conditions – hereinafter referred to as GTC -, regulate the conditions of purchase of the different products offered on our website: www.TSERFASHION.com , owned by TSER FASHION . (hereinafter TSER).
Users who make purchases on www.TSERFASHION.com fully accept these GTC and will be bound by them, as if they were written at the time of contracting/purchase.
It will be an essential requirement to read and accept the GTC, prior to the purchase of any product through www.TSERFASHION.com.
TSER FASHION reserves the right to modify the GTC at any time and without prior notice. The GTC will always be accessible from the website, so that the user can consult or print them at any time.
The prices and conditions of sale are for information purposes only and may be modified according to market fluctuations. However, placing an order by filling in the purchase form implies conformity with the price offered and with the general conditions of sale in force at that particular moment. Once the order has been formalised, the purchase will be understood to be fully completed, with all the legal guarantees that protect the purchasing consumer and, from that moment, the prices and conditions will have a contractual nature and may not be modified without the express agreement of both contracting parties. Spanish, French, English, German, Italian or Portuguese will be the language used to formalise the contract. TSER reserves the right to refuse and/or suspend access to the services provided on www.store.dreamlove.es for reasons of breach of contractual good faith, breach of applicable legislation, of these General Conditions of Purchase and/or in cases of fraud detected by this company and/or any of its suppliers.
Payment methods
The methods of payment through which you can buy in TSER are bank card, PayPal, bank transfer. The following bank cards are accepted: Visa, MasterCard and American Express.
All bank card holders are subject to validation and authorisation checks by the card issuer.
Orders can be paid in British Pounds, US Dollars , Euros and we also have a currency conversion system for International transactions.
Security in payment transactions
TSER guarantees that the personal data collected will be transmitted in a secure environment and will be used with the strictest confidentiality.
As part of the fight against fraud on the Internet, data relating to the Buyer’s Order may be communicated to third parties authorised by law or designated by TSER, for the sole purpose of verifying the identity of the Buyer, as well as the validity of the Order, the means of payment used and the planned delivery.
Once this check has been completed, TSER reserves the right to demand a photocopy of the Purchaser’s identity document and/or any other data relating to the Purchaser’s identity. The Buyer has the rights conferred on him by the regulations on the protection of personal data as set out in the Privacy Policy.
Deliveries
Delivery times will depend on the availability of each product, which is indicated on each and every one of the products offered. Orders that include several items will be sent in a single shipment.
Delivery times vary between 1 and 3 days at the customer’s choice for deliveries in Spain/Portugal and from 1 to 12 days for deliveries to the rest of the world. We cannot guarantee these delivery times, although we try to ensure that transport companies meet them whenever possible. We are unable to offer delivery within 24 hours.
We ship orders after confirmation of payment. In addition, we have control parameters for outgoing orders depending on the number of items.
Order Dispatch.
We usually dispatch all confirmed orders before 5pm for orders with destination Spain/Portugal and for the rest of the World we dispatch confirmed orders before 12am.
Reception of Logistics Agencies.
TSER. has technological systems for scanning products and triple-checked outputs. TSER is not responsible for damaged shipments received by the recipient, therefore the recipient is obliged NOT to pick up any shipment that has symptoms of having been tampered with by the logistics agency that may cause theft, robbery or manipulation of the contents. TSER guarantees a control of departures with packaging systems that allow the traceability of the article in perfect condition for delivery.
Compulsory procedures in the event of a damaged package.
In the event of an incident detected in the presence of the transport company:
Refuse delivery and clearly state the incident in detail.
Indicate the reason for the refusal of delivery to the Customer Service
Department of the transport company.

The notification of incidents and the formulation of complaints must be made as soon as possible and, in any case, within 2 working days of delivery of the product.
Mandatory procedures in the event of missing or damaged products.
It will be essential to take photos of the outer box to check the condition in which you have received your shipment in order to process any claim.
The Buyer must communicate the absence or deterioration of the product to the TSER Customer Service Department by the means specified in the previous section. TSER Customer Service may request any information relating to the identity of the Buyer or the recipient of the Order and may carry out any verifications that may be necessary for the case.

Cancellations
In accordance with current legislation, you can proceed to withdraw from the contract, without the need to justify such a decision and without penalty of any kind, within 14 calendar days of receipt of the goods by the customer. To do this, the conditions set out in the conditions for handling a return set out in the section “Handling a return” must be met.
The right of withdrawal shall not apply to contracts relating to:
The provision of services, once the service has been fully performed, where performance has begun, with the prior express consent of the consumer and user and with the acknowledgement by him that he is aware that, once the contract has been fully performed by the entrepreneur, he will have lost his right of withdrawal.
The products shall comply with the requirements of the Spanish legislation in force. TSER accepts no liability in the event of non-compliance with the laws of the country other than Spain in which the product is to be delivered (e.g. in the event of a product ban, etc.). It is the Buyer’s responsibility to verify with the local authorities of the country other than Spain where the products are to be delivered the applicable limits for the importation and use of the products and services he wishes to purchase.
The supply of goods or the provision of services whose price depends on fluctuations in the financial market that the entrepreneur cannot control and that may occur during the withdrawal period.
The supply of goods made to the specifications of the consumer and user or clearly personalised.
The supply of goods that are likely to deteriorate or expire quickly.
The supply of sealed goods in the categories of sex toys, sexual health cosmetics and lingerie which are not suitable for return for reasons of health protection or hygiene and which have been unsealed after delivery.
The supply of goods which after delivery and taking into account their nature have become inseparably mixed with other goods.
The supply of sealed applications or video or sealed software which have been unsealed by the consumer and user after delivery.
The supply of daily newspapers, periodicals or magazines, with the exception of subscription contracts for the supply of such publications.
The supply of digital content which is not provided on a tangible medium where performance has commenced with the prior express consent of the consumer and user with the knowledge on his part that he consequently loses his right of withdrawal.
Once we have received the product(s), we will refund you according to the method of payment you have used within 1 to 5 working days:
If you paid by card, we will credit your account.
If you paid by Paypal, the refund will be credited to your wallet account.
If you paid by bank transfer, the credit will be made to your bank account.
You will only be liable for any diminished value of the goods resulting from the handling of the goods other than what is necessary to establish their nature, characteristics or functioning.

Conditions for returns
Return of products with gift or promotion. The complete return (complete pack or article + gift) will be obligatory in order to be able to proceed with the refund. In the case of products that include app download codes, it will be a requirement not to have downloaded them in order to proceed with the full refund.
We will only accept returns of unsealed material in perfect condition within 14 calendar days of receipt.
Such returns will be processed as a balance refund, as there is no law that regulates the rights of return between companies, and these procedures are regulated according to the conditions of TSER.
We will not accept returns of products in blister packs or heat-sealed products, and other products with a broken factory security seal.
The above conditions do not waive the right to warranty or exchange of defective products. TSER reserves the right to refuse the return if any anomaly is detected in the returned product.
Warranties
The guarantee does not cover defects caused by incorrect use of the product and/or handling of the product other than what is necessary to establish its nature, characteristics or operation. In such cases, the consumer shall be responsible for repairing the product. They are, therefore, excluded from the guarantee:
Defects and deterioration caused by external events, accidents, mainly electrical accidents, wear and tear and use not in accordance with TSER’s instructions.
Products modified or repaired by the customer or any other person not authorised by TSER, as well as products which are the subject of a specific support contract.
Order cancellations
To cancel an order send an email to info@tserfashion.com. Those cancellations of orders that involve a refund to the customer and that are by bank transfer will have a maximum period of 30 days for administrative procedures, although we try that the period does not exceed 7 days.
Pricing
All prices quoted in this website were correct at the time of publication but errors and omissions are excepted (E&OE). Our site contains a large number of products and it is always possible that, despite our best efforts, some of the products listed may be incorrectly priced and we apologise if any offer is incorrect. Please advise us if this is the case and we will correct any errors without delay. We will verify prices as part of our sale procedures so that a product’s correct price will be stated on your invoice for your order. In these circumstances, we reserve the right to cancel the transaction notwithstanding that your order has been confirmed or otherwise accepted, without compensation to you. We will refund or provide a credit to you for the purchase price of the product in question if payment has been made.
All pricing is in local currency. TSER has the right to change pricing without notice.
In addition to the price of the products, you will have to pay a delivery charge, which will be as stated at checkout or on your invoice.
Matters out of our Control
We will not be liable to you or in breach of the Contract for delay or failure to perform due to a cause beyond our reasonable control and for any delayed or failed deliveries due to the fault of our courier.
We accept no responsibility or liability for the content or operation of websites which are not under our control but may contain our product.
Governing Law and Jurisdiction
These terms will be governed by English law and any disputes will be resolved exclusively by the English Courts. We reserve the right to amend these Terms of Sale at any time. Any goods supplied or sold by us, are governed by these Terms of Sale in accordance with English law.
If any provision of these Terms of Sale are invalid, void, illegal or unenforceable the validity, existence, legality and enforceability of the remaining provisions shall not be affected.
We do not accept your amendments to these terms and conditions.
